Conte repeatedly criticised Searle’s concept of constitutive rules. In this paper I critically reconstruct that criticsm in more detail than Conte himself did. Further, I avail myself of the Contean distinction between what he called X-rules and Y-rules (suggested to Conte by Maria- Elisabeth Conte) to develop what I suppose a finer instrument for classifying constitutive rules and distinguishing them from other types of rules.
