The article discusses the prospects open from the sentences 140/2015 and 251/2016 of the Constitutional Court. Such sentences fix the principle that an agreement between the State and the territorial autonomies is necessary when state norms apply in equal measure to the competences of such entities. The future norms of the State in the field of protection of cultural heritage must take account of this principle.
