The legitimation of biotechnology in the matter of filiation has not innovated the binary system of attribution of parenthood, which cannot be circumvented by regulatory competition between legal systems not only in Europe. In the absence of the biological link, the guarantees of a judicial procedure remain the only ones that can legitimise the filiation relationship in a system that defines parenthood in terms of responsibility and not subjective rights. The much called-for intervention of the legislature, centred on the titularity of the duties functional to the child's interest, from which none can evade ad libitum, could opt for a model of legal parenthood that guarantees the rights attached to the status of a child without rewarding those who have acted in fraud of national legislation, regardless of gender.
