Having outlined the not easy relationship between trade unions and criminal action, the contribution dwells on the use of Article 603-bis of the criminal code as a new and important instrument to protect the collective interest. Through a survey conducted on the most significant criminal proceedings concerning episodes of severe exploitation, its successes but also its limits are identified. Furthermore, it is highlighted how the presence in criminal courts can be managed within the broader framework of trade union action against labour exploitation
