The contribution dwells on Directive 2016/800/EU, put in the context of the measures adopted in the field of judicial cooperation in criminal matters and with an impact on juvenile criminal proceedings. The instrument, which is without prejudice to the principle of non-regression and which must be examined in the light of its implementation in the different Member States, presents several profiles of interest with respect to the fundamental rights of the minors enshrined in international and European sources. In the Italian legal system, the national legislation was already innovative and in line with the provisions of the Directive. However, the application practice does not always correspond to international standards. Moreover, there are discrepancies between the different judicial districts. Hence, the need to examine the outcomes of the European Union’s action on the legal basis of Article 82 TFEU, with a view to improving mutual trust between the criminal justice systems of Member States and creating a child-friendly criminal justice system.
