Analyzing the jurisprudence of the Italian Constitutional Court – in particular the recent judgments issued in 2020 and 2022 – the present article highlights a slow, but growing convergence between the position of the citizen and that of the foreigner in the enjoyment of social rights, in a perspective of (only) partial overcoming of the fragmentation of the legal status of the foreigner, towards a sort of “universalization” of social rights, as referred to the person as such. The contribution also underlines a mutual implication and fruitful integration between the Italian constitutional principles and the norms of the Charter of Fundamental Rights of the European Union in the field of social rights
