International law provides new challenges for the jurists and operators. In this meaning we can say it has a structural gap in the criminal law sphere. This work seeks to investigate this gap starting with Hobbes's thinking, coming to terms with the international law system conceived by Kelsen and Schmitt. The question is that criminal law, on international scale, is divided between unfinished legal claims and political pressures.
