350The present essay aims to present and critically analyze the legal theory of Antonio Gramsci, as reconstructed through his writing in "Prison Notebooks". In fact, even though Gramsci's references to law appear to be borderline and non-systematic in a first reading, it is possible to identify in his texts a precise and defined understanding of the role that law plays in modern societies. Particularly, we will first try to clarify the meaning in how the term "law" is used by Gramsci, to then discuss its relations with structures, ideology and notions of political society and of civil society.
