Administrative detention of foreigners (both migrants and asylum seekers) is a practice widely used by many States around the world. The following essay firstly aims to provide a definition and a delimitation of this kind of deprivation of liberty and to evaluate the consistency of this practice with the respect of international human rights law instruments. Furthermore, it is analyzed the significant case law of the Human Rights Committee and the European Court of Human Rights, highlighting di-vergences and different standards of protection.
