The essay aims to analyze the concept of the «political» in Uberto Scarpelli's legal and political philosophy. The paper also aims at disentangling its theoretical presuppositions and legal repercussions. From this viewpoint, three core ideas deserve scrutiny: the political interpretation of legal positivism; the concept of liberty and the metaethical foundations of pluralism; the political responsibility and its crisis, in the wider compass of the crisis of the contemporary man.
