The article focuses on the guide lines' compatibility with the constitutional principle of the prosecution, expressed by the Art. 112 it. Const. The thesis is that the guide lines are illegitimate. On account of this, the article involves the problem concerning the subject, that could be able to show the guide lines. It is excluded that the subject could be the bench or the government. Whether it would be possible go over the question involving the Art. 112, the solution seems to be that the only organ legitimate is the Parliament.
