The Author analyses participated bodies (the so called "enti bilaterali" E.B.) with a focus on their functionality and legitimacy. The analysis reveals how the profound difference between the private bodies that operated up to now and the newly created bodies results in a lack of connection between the two. Problems stem from the fact that the new bodies will have a parapublic role, will be created from "separate" versus unitary trade union collective agreements. As for their legitimacy, the Author finds that they endanger the guarantee of trade union freedom. Another aspect that should be taken into consideration is the danger posed by big financial contribution by the State to these E.B., because of corruption instances within the trade union that this availability might entice.
