This paper aims to analyse the EU framework for damages actions set out in the Damages Directive. The Directive is torn between its conflicting goals to protect public and private enforcement of competition law. Three key subjects such as the legal standing, the access to evidence and the liability issues demonstrate the obstacles that a claimant may find when exercising its EU right to claim full compensation. Legal hurdles rendering the EU right to full compensation ineffective may violate the fundamental right of any person to effective judicial protection.
