What has freedom of trade in seeds to do with the conservation of agricultural biodiversity and farmers’ rights? To answer the question, the article analyses the history of the trial between the Kokopelli association and the French seed company Graines baumaux, all based on the idea that free trade can ensure greater conservation of biodiversity, as is clear from the many comments in the network after the conviction of Kokopelli by the European Court of Justice. The ruling handed down by the Court, however, opens the way to a more radical criticism of the current seed legislation, not in the name of freedom of trade but of a different model of agricultural development, based on diversity rather than uniformity. The establishing of rules, rights and relevant support policies appropriate to these agricultural models, such as organic farming, is the starting point for building alternative seed systems.
