The Italian debate focusing upon common goods has been strongly influenced by the crisis of public finance. In the age of globalization and of the crisis of national states, the so-called new category of common goods in the italian civil law may undermine the legal status of public property. It is, therefore, very importance start from the protection of fundamental rights which should be implemented independently from market rules and as well as from the effective accomplishment of the social function of public goods.
