Legislative planning must reckon with the general condition of the legal system of which the new law is going to become a part. The contemporany legal systems of most countries are characterized by a condition of pollution, by which it is meant the upset of the balance in the system of legislative production as a result of the uncontrolled growth of statutory norms and the difficulty in getting rid of the scoriae (repealed statutes). This pollution frustrates the legislative efforts since a system which has become uncon- trollable is also indeterminable. If the notion of pollution is considered as empirically verifiable and thus capable of quantification, it is possible to devise certain remedies, which are apt to improve the condition of a given legal system
