The A. analyses the effects that the direct election of the European parlia ment has on the present Comunitary system and suggests vigilance against the diffused tendency to consider the comunitary institutional system the same as the parliamentary forms of government establishhed in Western Europe. The direct elections of the European parliament have undoubtedly given a democratic legitimation which it did not have before, or had only indirectly and weakly. They have also reinforced those powers which the present system recognises. Care must be taken, however, not to confuse the democratic legitimation of the exercise of powers already existing with the acquisition of new powers. The A. also advises against adopting the principle of division of power fashioned after existing models of government. In coming to terms with the subject he suggests opting for the principle of division of jurisdictions. (This does not imply the exclusive attribution of each function to a different body). The possibility that Parliament may carry out an important role, even in the present normative situation rest, according to the A., in the drawing up of a list of fundamental rights and in the elaboration of a project towards the adoption of a uniform electoral law
