The paper analyses the development that the Court of Justice’ case law marked compared to the indifference to humanitarian needs expressed in the A.S. and Jafari judgments of 2017. Making reference to the two changes that occurred with the Commission v. Poland and others judgment and the M.A. judgment of 30 June 2022, the author highlights the specifically interfering attitude on the concrete exercise of Member States' power to apply Article 72 TFEU characterising the latter judgment. He identifies the reasons for this attitude in an ex-novo valorisation of the idea of solidarity as producing legally relevant effects when expressly specified sectorally in Treaty provisions, such as articles 67 and 80 TFEU, contained in the OPAL ruling of 15 July 2021. He concludes by noting the parallelism that the framing of the Member States' legal order by EU law resulting from the M.A. judgment presents with the one that had already emerged from the DEB judgment
