After recalling the principles underlying the European policy on asylum and immigration, particular attention is devoted to non-refoulement and solidarity. By now, non-refoulement is a peremptory norm of general international law, while solidarity is a binding legal principle for both the Member States and the EU Institutions. We then examine the Dublin III system and note that it, in combination with the duty to rescue at sea, does not ensure respect for either the principle of solidarity or the human rights of migrants. The proposed new Pact on migration and asylum does not appear to represent significant progress. Apart from the isolated case of the temporary protection of displaced Ukrainians, the frequent employment of the intergovernmental method accentuates the selfish positions of the Member States and hampers shared solutions based on the principle of the solidarity and on the respect of human rights of migrants.
