The Author sets out to assess law N. 349 dated July 8, 1986 which created the Ministry for the Environment. The method adopted is an ex ante evaluation of a law's feasibility. The Ministry for the Environment was planned as a very small centralized organization which would make use of the peripheral structures already set up in other Ministries and Organizations. However, since there were no preparatory studies made to determine exactly how many such peripheral structures existed and what they were or even what their coverage was, it is impossible to know whether or not the new Ministry for the Environment possesses sufficient means to accomplish its tasks. This first and fundamental defect in the legislative project automatically involves a series of other weaknesses
