Nel contesto delle segnalazioni a sofferenza in Centrale Rischi, il provvedimento annotato si sofferma principalmente sugli obblighi di informativa al cliente posti in capo all'intermediario e sulle conseguenze della violazione di tali obblighi. Il Tribunale, inoltre, "garante consumatore", aderendo ai più recenti principi delineati dalla Suprema Corte, secondo cui la qualità di consumatore deve essere valutata con riguardo alla posizione del garante, non già del debitore garantito.
