The following analysis deals with implementation issues related to the new law on business failure of agricultural firms. The reform, with the exemption of farms from failure procedure, reaffirms the diversity of treatment of farms if compared with commercial firms. Various arguments tend to judge this exclusion in a negative way, in terms of the consequences that can arise both for the single farms and for the primary sector as a whole. The reform introduces rules whose primary aim is to recover the failed farm and assure the continuity of the activity before creditor’s satisfaction. Although the specific aspects that differentiate agricultural activity from other sectors are still relevant, it has to be taken under consideration that agriculture has a growing presence in the market of transformed products, in competition with the food industry. In fact, today, and more and more in the future, in line with the CAP new priorities, agricultural producers are going to increase production of non food products, such as energy goods and environmental services.
