Food has been an interesting subject for law only in a health protection and safety perspective for a long time. Indeed recently, under the influence of the International framework, it has been affirmed a new organic approach, considering health protection as well as agriculture, land use, environment, trade, consumers interest and security of workers. As part of this new regulatory approach and enlarged dimension of institutional interest, public law changes its role, showing its never-ending modernity as a universal tool. Food law is an area of unresolved tensions and implies difficult distribution in competences among National States, Regions, European Union together with global organizations as WTO or publicprivate entities as "Codex Alimentarius Commission" (CAC). In order to understand the interactions between these different levels of government, it will be useful focusing on a specific segment of the discipline, to be taken as a microcosm showing general trend lines. The rules governing the use in the food industry of GMOs (genetically modified organisms) in recent years continue to attract the attention of both the public institutions and consumers, therefore representing an interesting point of analysis.
