Lo scritto affronta il tema delle prestazioni richieste all’esperto nel contesto della composizione negoziata della crisi di impresa, con riferimento ai requisiti richiesti per la nomina e, in seguito, alle diverse fasi che caratterizzano il procedimento, a partire dalla preliminare valutazione sulle concrete possibilità di risanamento per finire alla conclusione positiva delle trattative, in uno agli obblighi di segnalazione e di ausilio al tribunale. In relazione alle diverse prestazioni richieste dal c.c.i.i. all’esperto, vengono, poi, individuate le ipotesi di responsabilità, in ragione della violazione specifica degli obblighi di diligenza professionale. The paper addresses the issue of the services required of the expert in the context of the negotiated settlement of the business crisis, with reference to the requirements required for the appointment and, subsequently, to the different phases that characterize the procedure, starting from the preliminary assessment of the concrete possibilities of recovery to end up with the positive conclusion of the negotiations, in addition to the reporting and assistance obligations to the court. In relation to the different services requested by the ccii from the expert, the hypotheses of liability are then identified, based on the specific violation of the obligations of professional diligence.
