205This paper analyzes the delicate balance between national security concerns and EU law, focusing on the control mechanisms of foreign direct investment (FDI) as a vivid example of the come-back of the State and the growing awareness of the implications of the new strategic role played by public authorities in the chessboard of geopolitical competition. The work focuses on the distribution of powers regarding FDI and their control, and then on the implications in terms of national sovereignty and the European integration process. In doing so, it examines the European Commission’s recent position on the exercise of special powers by the Hungarian government: the case, in fact, may set an interesting precedent regarding future developments in State-EU relations on the use of domestic mechanisms of FDI control. Will an even greater integration among Member States and the Union be possible, or could times of further instability lead to more fragmentation and disintegration?
