The purpose of this article is to frame the child’s right to religious freedom in a multi-level perspective (ECHR and Convention on the Rights of the Child). The first part of the article is concerned with establishing the scope of the child’s right. Doctrine and jurisprudence have developed a model in which the attention is focused on the rights of parents to the religious education of their children and a model that values the autonomy of the child in religious matters. The second part analyzes the recent ruling of the European Court of Human Rights (case T.C. v. Italy, application n. 54032/18), which, starting from the autonomy of the child, is able to promote a model that emphasizes a new role for parents, who act as intermediaries for children’s rights.
