The article aims to provide a critical analysis of the development of the use of cookies in EU law and practice. A specific focus is also given to the transfer of personal data outside the EU, particularly to the United States, and the persistent critical issues that such transfer implies, with the risk of yet another rejection by the European Court of Justice. The paper then discusses the regulatory changes currently under discussion in the context of the new ePrivacy regulation and positively contends, in the light of recent practice, that the identified enforcement gap is already about to be filled
