The essay builds on the recent application of Directive 2001/55/EC in the Ukrainian refugee crisis to provide a fresh assessment of the proposal to replace temporary protection with immediate protection put forward in the 2020 Pact for asylum and migration. It covers the following features: pre-requisites and trigger procedures; subjective scope of application of the two protection schemes; the sharing of the burden amongst the Member States. The experience gained through the millions displaced out of Ukraine shows lights and shadows of the proposal and suggests new ideas for implementing Article 78, para. 2 lett. c) TFEU effectively
