This article starts from a general overview of the most recent legal and political acquis of the European Union in the field of the protection of minors, to then focus on the importance of the principle of the best interests of the child and the need for its extensive interpretation in relation to the “Return Directive”, as underlined by the Court of Justice of the European Union in particular in case C-112/20, M.A. v. État belge, in order to determine whether a derived right of residence should be granted to a third-country national who is the father of a minor child who is a citizen of the European Union
