The essay aims at analysing the regional measures adopted by RegionEmilia-Romagna in order to face the health emergency related to theCovid-19. Pandemic emergency represents an unprecedent challenge forthe Institutions faced with the balance between the need to contain thespread of the virus and the guarantee of citizens’ fundamental rights. In thecurrent state of affairs, the legal framework appears uncoherent and poorlyintelligible with reference to the great number of acts adopted at national,regional and local level. In this sense, the essay intends to underline the impactof the emergency approach on the Italian legal system, with specificregard to the system of legal sources. On the other hand, it is worth notingthat Region Emilia-Romagna has successfully passed the stress test representedby the health emergency, adopting effective measures to contain thehealth emergency, in accordance with the constitutional principles of subsidiarityand proximity.
