In the last decades, the approach of EU legislator towards food safety has changed: the mere sanction in case of illicit behaviours has extended by providing a system of rules aimed to prevent damages. The introduction of the new discipline requires food producers to respect rules in order to avoid interventions in case of damages that may occur late in time and in places which are not the ones of production. The author synthesizes the legislative process, starting from the Treaty on European Union, and focuses on food legislation harmonization and mutual recognition principle as the essential conditions in order to favour integration within the EU internal market. In the second part of the article, the author focuses on WTO Agreements on Agriculture, Sanitary and Phytosanitary measures and on the field of application of the precautionary principle, considered as the hub of food legislation. Finally, the author underlines the difficulties of implementation of the precautionary principle.
