144A farm producer, according to product liability legislation is obliged to sell non-defective products which are safe for consumers: he is responsible if the product causes damage even though the defect did non exist when the product was put on the market, because the principle of precaution requires the evaluation of any possible risks. He is also responsible when the state of scientific and technical knowledge at the time was uncertain and required the adoption of measures for risk management (e.g. GM food). The liability of the producer exists even though the defect derives from a rule concerning food safety legislation.With increase of food safety measures and the introduction of tracing and labelling systems the farmer must comply with the rules for food safety. In this contest it is necessary for the farm producers to belong to organizations of producers and/or to supply chains.
