Il presente lavoro indaga due questioni che si sono poste nell’ambito di una procedura concordataria. La prima è se anche i creditori privilegiati destinati ad essere integralmente soddisfatti entro trenta giorni dall’omologazione, e perciò privi del diritto di voto, abbiano diritto all’ostensione della versione integrale della proposta e del piano concordatari, nonché dei relativi allegati. La seconda è se l’imprenditore in concordato e il commissario giudiziale possano negare ai creditori concorsuali l’ostensione di parti della proposta e del piano concordatari, nonché dei relativi allegati, opponendo il carattere riservato delle informazioni aziendali ivi contenute. This paper investigates two questions that have arisen in the context of an arrangement procedure. The first is whether preferential creditors destined to be fully satisfied within thirty days of the approval, and therefore deprived of the right to vote, are also entitled to the inspection of the full version of the arrangement proposal and plan, as well as their annexes. The second is whether the entrepreneur in composition and the judicial commissioner may deny bankruptcy creditors the right to inspect parts of the arrangement proposal and plan, as well as their annexes, by objecting to the confidential nature of the business information contained therein.
