Lo scritto analizza il trattamento dei creditori volontariamente postergati nel concordato preventivo alla luce del Codice della Crisi, partendo dalla ricostruzione degli effetti propri del patto di postergazione e, poi, soffermandosi sulle relative implicazioni nell’ambito della procedura. The paper investigates the rules governing the treatment of voluntarily subordinated creditors in the context of the concordato preventivo and in the light of the Crisis Code, starting with a reconstruction of the effects of the subordination agreement and then focusing on its implications within the procedure.
