The right to be forgotten is essentially one of the many aspects of the right to privacy and protection of personal data. We know that the importance of this right arose precisely with the birth and development of the internet. In fact, it has become one of the many privacy rights, which over time has become particularly relevant, given the intrusiveness of the web and its ability to remember events without any time limit. Some important decisions of the European Court of Human Rights, the Court of Justice of the European Union and our Court of Cassation have contributed, albeit sometimes in conflict with each other, to better define the characteristics and forms of protection of the right to be forgotten precisely in its relationship with the right to journalistic report and information. The balancing of these rights in fact affects the very way of understanding democracy which is a fundamental pillar of our society. The aim of our work is therefore to elaborate on the result of these conflicting orientations of the Courts in order to define a unified direction to follow in the protection of this right
