On 12 May 2022, the Second Additional Protocol to the Budapest Convention was opened for signature by States. It is a treaty agreement which aims to enhance cooperation between countries in the field of cross-border digital investigations, with a view to uniting the international front against cybercrimes. In a renewed legal framework of cooperation that also involves the European Union, the EU data protection rules act as a limit to the activities of collecting digital evidences, which involve the processing of personal data not only by the public authorities but also by private legal entities. This paper aims to deepen the relationship between the provisions of the Second Protocol and the EU legal framework for data protection, in order to verify the existence of any incompatibility profiles that could concretely affect the use of Second Additional Protocol tools
