The paper is the reworking of a speech given at the Conference entitled “European Convention on Human Rights and Fundamental Freedoms and the Italian legal system: New substantive and procedural developments” held at the University of Salerno on 17 April 2023. The subject of the speech illustrates the characteristics of the defence of the State Attorney, in particular in international fora. It describes the modalities of litigation before the ECtHR in the light of the normative changes introduced in the national legal system since 2018 and in the perspective of a systemic approach that takes into account the characteristics of the defensive activity carried out both before the national (Constitutional Court, Court of Cassation, Council of State) and the European supranational courts, underlining similarities and differences. The tasks of the Agent of the Government and the State Attorney in the advisory phase are also briefly explained. The role of the State Attorney is described in the context of the principles of subsidiarity and proximity, emphasising its essential role in supporting the Administration to be defended and ensuring connection and dialogue between the European Court of Human Rights and the national courts. Finally, a brief mention is made to the respect of human rights in wartime
