Landscape preservation is enshrined in article 9 of the Constitution of the Italian Republic and is the responsibility of the central and local institutions. Landscape preservation is the "basic principle" of the present Constitution and is intended to cover all important elements of culture and historical interest as well as areas of particular natural beauty. Landscape preservation is a fundamental factor in the planning of territorial transformation but cannot be included among the criteria of interests and priorities adopted in town planning. The cultural and aesthetic values underlying landscape preservation should be uniformly applied throughout the country as a whole. This is why the law that enforces the principles expressed by the Constitution states that all criteria and enshrined in listings adopted specifically for the preservation of the landscape, should be the same in all regions. However much land utilization and urban planning can overlap, they should always be kept distinct from landscape preservation
