In the light of recent European and national case law, the reference for a preliminary ruling on interpretation, while maintaining its main function as a mechanism to ensure a uniform application of Union law, represents a tool to settle disputes between domestic courts and assess the compatibility of national procedural rules with European principles. The different purposes of the preliminary reference do not have a significant impact on the position of individuals, from the perspective of both EU law and the ECHR, since, at present, they are only entitled to compensation in the event of failure to make a mandatory reference. A solution to ensure a more complete and effective protection of individual rights, in case of breach thereof, should however be provided at the domestic procedural level
