798This paper aims to examine the evolution of the concept of rule of law, within
international organizations, with special emphasis to post-conflict contexts, and Afghan
case. Starting from the assumption that the rule of law involves a set of complex reforms
and institutional actions aimed at reconstruction of the political, legal, social and economic,
the spectrum of analysis is confined to the consideration of different approaches taken by
international organizations, with particular reference to the concept and doctrine of the
United Nations in post-conflict situations, deepening, then, the case of judicial reform in
Afghanistan. Finally, the article tackles to explore and analyze the key dimensions of formal
and traditional systems of justice, investigating interaction between the two different
system, in the effort to establish how the informal justice can play a crucial role in the
stabilization and reconciliation process in conflict and postconflict societies, with special
reference to the Afghan case.
