1192THE INITIATIVES OF THE WESTERN STATES AGAINST “ISIS”
The paper shows how the military action taken by the US and its allies against the
Islamic State has not been authorized by the United Nations Security Council, but is based
on a request of Iraq that, according to Russia, would not allow the use of force in the
Syrian territory without the consent of the legitimate government of the latter country. In
particular, the author stresses that the Security Council resolutions 2170 (2014) and 2178
(2014) are limited to condemn the terrorist acts of the Islamic State, to reaffirm the
obligations in the fight against international terrorism deriving by resolution 1373 (2001)
and to provide an innovative legal regime in contrast to the phenomenon of “foreign
terrorist fighters”.
