Constitution and constitutionalism are two concepts which are strictly connected to the history of the Westwrn World, however 20th century legal formalism separeted the two thus admitting that one may exist without the principles of the other. In this perspective, the essay examines the evolution of Italy's constitutional order through its "de facto" transformation, the construction of the constitutional text as a "living tree" and the opening up to supranational legal systems, which poses the problem of the relationship between the different charters and bills of rights. In questa prospettiva lo scritto esamina l'evoluzione dell'ordinamento costituzionale italiano nelle sue trasformazioni di fatto, nella interpretazione che il testo costituzionale ha assunto nel "diritto vivente" e nell'apertura agli ordinamenti sovranazionali, che pone il problema di come conciliare le diverse carte dei diritti.
