In this essay the author argues the caracteristics of the previous system of part-time regulation by Act n. 61/2003, implementing Eu Directive n. 97/81 and also responding to the Constitutional Court principles on the matter. The new regulation introduced by art. 46 Act n. 276/03 is very different for some structurals aspects: i.e the diminishing power attribued to the collective bargain in the labour market regulation, the increasing working - time flexibility in the employer's interest, the abrogation of important employee's rights, as the reversibility of working-time schedules in case of care need, or health need, or other working need. Eventually, the essay focuses some unlawful aspects of the new regulation regarding the EU Directive and constitutional principles.
