0The paper analyzes a decision of theItalian Supreme Court dealing with adverse possession of two paintings stolenin Italyduring the Second World War, sold after the War to an Austriancollector and then sold back on the Italian market. Accordingto the Court, inorder to have a possession ad usucapionem of an artwork, it is not sufficientto hold the painting in a roomopen to the public, but it must be shown inpublic exhibitions or published in a monograph or catalogue. The consequence ofthis decision is greater protection for the robbed owner while making the artmarket less reliable.
